Things You Need to Know if You Are Hurt at Work:

1) Document the Accident

 Notify your employer and/or supervisor an accident occurred and take pictures of the area where it occurred. Be sure to take pictures of your injury as well. Take note of who was around at the time of the incident, in case they need to be called upon as a witness during your claim. The more documentation, the better.

2) Getting Your Claim Started

File a two-page form, known as a C-3 form, with your employer and the NYS Workers Compensation Board (WCB). You can obtain the C-3 form from the NYS Workers Compensation Board website here. Filing of a C-3 will index your claim with the  WCB. The WBC is responsible for the administration of your claim. 3) Knowing Your Numbers

Each claim will have two numbers. The WBC will forward a Notice of Indexing, which contains a WCB Case Number, to your attorney and your employer’s insurance company. The insurance company will also forward a Carrier Case Number, that hospitals and treatment centers will use for billing. We recommend documenting and saving these numbers, as they are necessary to recover and file information regarding your claim. Injured workers are not responsible for any medical bills.

4) Getting a Hearing

Generally, the WCB will schedule a hearing to determine the nature of your injury (based on the  findings of your physician), period of disability associated with your injury, and to confirm the insurance company has paid you the correct rate of compensation during your recovery.

5) Your Settlement
